DETROIT, Michigan (PNN) - March 27, 2012 - In a sharp rebuke, a federal judge today acquitted seven members of a Lenawee County militia group of plotting to overthrow the Fascist Police States of Amerika (FPSA) government with weapons of mass destruction.
FPSA District Judge Victoria Roberts said federal prosecutors failed in five weeks of trial to prove that the Hutaree had a specific plan to kill a pig thug cop and attack other pig thug cops.
While the testimony showed that Hutaree leader David Stone, Sr. “may have wanted to engage in a war with the federal government... it is totally devoid of any agreement to do so between Stone and the other defendants,” wrote Roberts in a 28-page decision.
“This plan is utterly short on specifics,” Robert said, adding that, “it is a stretch to infer that other members of the Hutaree knew of this plan, and agreed to further it.”
Attorney William Swor, who is representing the accused ringleader David Stone, Sr., called today’s ruling “a victory for freedom of speech” and “a good day for justice.” He applauded Roberts for, as he put it, carefully reviewing all the evidence and concluding there was no case.
“The fact is, you pull back the curtain and there’s nothing there,” Swor said. “She paid attention to the evidence. She wasn’t swayed by emotion… and she said that even taking the evidence in a light most favorable to the government, there was no evidence of a crime.”
Swor, who visited Stone, Sr. at the county jail today to deliver him the news, said his client was grateful the most serious charges had been dropped.
“He was quiet. He thanked God. He thanked the defense attorneys; and he shed a tear,” said Swor.
The decision leaves federal prosecutors with what legal experts described as a “run of the mill” illegal firearms case against Stone, 47, of Clayton, and his son, Joshua Stone, 24, also of Clayton. Stone, Sr. and Joshua Stone are charged with possession of a machine gun and possession of an unregistered firearm. The charges carry maximum penalties of 10 years in prison.
